Summary of Tyrants’ Unlawful Actions
On 10/26/20 Monterey County Health officer J. Lamb tromped into Aloha Coffee & Café ("Aloha"), and left a citation for face covering violations even though Richard and his employees wore face shields and obeyed the 6-foot distancing decrees. Officer Lamb acused Richard of not wearing the face shield exactly as demanded and issued a citation, even though Richard told Lamb that he is exempt from wearing a face covering due to medical conditions. [Passage To Liberty notes that Richard's first mistake was complying, at all, with any of the unlawful mandates, for doing so is an admission of jurisdiction.]
After receiving invoices and further harassment from the County, Dunnuck called Rick Encarnacion at the Monterey County Health Department on November 19, 2020, whereupon Encarnacion stated that the disability laws "are not considered at this time" and saying that there are no exemptions for food handlers. Then, on December 2, 2020, two health dept. officials, Roger Beretti and his associate, marched into Aloha and told him that continued violations of the Monterey County Code ( MCC 10.04.110) and California Retail Code (CRFC) had subjected him to the issuance of a closure order his facility permit was immediately suspended and he was ordered to close his business, even though Dunnuck's contract with the Monterey County Health Department for the health permit has no terms of this kind. Over the next week, Dunnick was visited by from police officers and various government actors, repeatedly issuing citations higher and higher fines for no-complaince. Ultimately, they ordered his utility services curtailed, stole his electric generator, and destroyed his source of making a living. All of these acts were done under Color of Law, without a warrant and without Due Process.
